PRIVACY NOTICE

A. Identity of the Party Responsible

Villa Segovia of 45 Avenida Sur 735, Adolfo López Mateos, 77667, San Miguel de Cozumel, Quintana Roo, is a company committed to protect your privacy. Our party responsible for the Protection of Data is the Department of Personal Data and is located at the same address. It can be contacted by writing to auditoria@costamed.com.mx 

B. Personal Data

For the purposes outlined in this Privacy Notice, Villa Segovia may collect your personal information in a variety of ways: when you provide the information directly; when you visit Villa Segovia’s websites; when you use the online services offered by Villa Segovia through data you authorize Villa Segovia to take from your social media (Facebook, Twitter, LinkedIn, Google, etc.), or when you connect to Villa Segovia’s Wi-Fi; and when we gather information through means other than those mentioned above, allowed by the applicable law.

The personal information gathered through the abovementioned means, is: 

1. Identification information: name(s), last name(s), address, home, mobile and/or work phone numbers, marital status, signature, email, gender, age, date of birth, username, and password. 

2. Financial information: cardholder’s name, credit card’s number, expiration date (for online transactions).

3. Billing information: name or company name, tax identification (RF, in Spanish), legal address.

4. Information on preferences: pertaining to the room, services required and/or reason; travel preferences and special requirements. 

C. Sensitive personal data:

Sensitive personal data is the personal data that affects the most intimate sphere of its owner, or whose improper use may give rise to discrimination or entail a serious risk to the owner. In particular, considered sensitive is that data that may reveal aspects such as racial or ethnic origin, present and future health status, genetic information, religious, philosophical and moral beliefs, membership to a union, political opinions, sexual preferences. Villa Segovia does not collect sensitive personal data. Should you require a particular service for which you will provide this sort of information, Villa Segovia will use it only to provide such service and meet your specific needs.

Due to the health emergency resulting from COVID19, in accordance with Article 10, Sections V and VI of the Federal Act on the Protection of Personal Data Held by Private Parties, Villa Segovia will gather data related to your health for the sole purpose of ensuring health protection for you and other people in the hotel. The information will be held for the tine necessary to fulfill that purpose. 

D. Purpose and Treatment of the Personal Information

These are the reasons that give rise to the legal relationship and are necessary for the provision of the service: 

1. The personal information you provide will be used by Villa Segovia to render the services you request, or which are part of a program you have enrolled into, or purchase made: reservations, vacation packages, vacation club membership, affiliation to our loyalty programs, affiliation to our referral programs, events and social gatherings, purchase of tourist products and/or services. 

2. Villa Segovia may use personal information to improve the service and, where appropriate, identify your preferences during your stay making it more enjoyable. 

Reasons that do not give rise to the legal relationship and are not necessary for the provision of services:

1. As well, the information may be used to offer tourist and commercial products and publicity to you by sending advertising, special services, newsletters, surveys, raffles and other online contests. 

E. Restriction to the Use or Disclosure of Personal Information for purposes that do not give rise to a legal relationship.

For you to be able to restrict the use or disclosure of your Personal Information regarding the reasons that do not arise the legal relationship, we offer the following: 

Your registry at the Public Register to Avoid Advertising under the Federal Consumer Protection Agency (PROFECO) so your personal data is not used to receive publicity or advertising from consumer goods or services’ companies. For further information you may visit PROFECO’s website or contact them directly. 

F. On the Exercise of the Rights of Access, Correction, Cancelation and Disagreement.

Access, correction, cancelation, or disagreement regarding the information you provide to Villa Segovia as indicated by the Federal Act on the Protection of Personal Data Held by Private Parties can be done through a written petition to the Department of Personal Data to the following address: 45 Avenida Sur 735, Adolfo Lopez Mateos, 77667, San Miguel de Cozumel, Quintana Roo from 9 am to 2 pm Monday to Friday or by email to auditoria@costamed.com.mx

At the very least, the petition must contain the following: (i) Name of the Holder of the Personal Data; (ii) Email address to receive notices; (iii) Documents proving identity or, as applicable, legal representation of the holder; (iv) Clear and precise description of the personal information over which the right is sought to be asserted and the right that is intended to be exercised; (v) Any other element or document that would facilitate finding the personal data. If the petition does not meet any of the above requirements, 5 days from the date the request has been received, the Personal Data Department may ask you to provide the elements or documents necessary to complete the processing of the petition. You will have 10 days to comply. If no answer is provided within said term, the respective request will be deemed as not submitted. 

To inform the resolution, the deadline to attend the petition will be no longer than 20 days from the date of its reception so that, if appropriate, becoming effective within 15 days after the answer has been issued. To protect your confidentiality, Villa Segovia will forward the answer to your petition to the email you have provided to the effect and be available at the address indicated in the preceding paragraph. 

G. On Withdrawing Consent for the Use of Your Personal Data. 

You can withdraw the consent you have given us for processing your personal information. Bear in mind that Villa Segovia might not be able to answer all cases concerning your petition or complete it immediately, as it is possible that a legal obligation may require us to continue processing your personal data. Also, you should consider that, for certain purposes, consent withdrawal implies that we can no longer continue providing the service you asked for, or otherwise that the relationship with Villa Segovia will end. 

To withdraw your consent, you must send a written petition to the Department of Personal Data to the following address: 45 Avenida Sur 735, Adolfo Lopez Mateos, 77667, San Miguel de Cozumel, Quintana Roo from 9 am to 2 pm Monday to Friday or by email to auditoria@costamed.com.mx

Processing the petition and attention thereof will be carried out in accordance with the provisions set forth in Section F above.

H. Personal information control and safety. 

Villa Segovia’s commitment is to take the necessary measures for protecting information that has been collected, by using secure technologies and access control procedures, use or disclosure of your personal information without authorization, for instance, storing personal information in Data Center servers with limited access controls. For online transactions we also use safety technologies that protect personal information transmitted to us through different electronic media, by using a secure server.

However, no secure or data transmitting system over which the company has no full control and/or which relies on internet, may be fully considered secure. 

I. Electronic media and cookies

In the event you use electronic media for your personal data, cookies will be enabled to provide a better service. 

Cookies are small bits of information sent by the website to your browser.

Cookies are stored in the hard drive of your computer and are used to determine preference when you connect to the services offered by our pages also tracking certain searches or activities done by you within our sites. 

In some sections of our website, we require the client to enable the cookies as certain features need them to do their job. Cookies allow us to: a) identify when you access our sites allowing us to provide you with a customized experience; b) know personal settings of the site specified by you – for example, cookies allow us to detect the bandwidth you selected when accessing the homepage of our sites, thus we are able to know what type of information is advisable to download; c) make an estimate of the size of our audience and measure traffic parameters, given that every browser that accesses our sites acquires a cookie that is used to determine the frequency and visits to different sections of our sites. This reflects your habits and preferences, and the information helps us improve the content, headlines and targeted offers for our users. Cookies also help track some activities. J. Transfers

Villa Segovia only transfers personal information in the events provided by Article 37 of the Federal Act on the Protection of Personal Data Held by Private Parties.

K. Changes to this Privacy Notice

Villa Segovia may, at any time, update this Privacy Notice. Should there be any substantial changes to this Notice, we will inform through our web pages mentioned in section A of this Privacy Notice, So, for these updates we encourage you to regularly visit this Privacy Notice.
